1. Acceptance of These Terms
These Terms and Conditions govern your use of the AcountAPill website, mobile application, services, features and related content (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services. AcountAPill may update these Terms from time to time. The updated version will be posted on the website with a revised effective date. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
2. What ACountAPill Does
AcountAPill is a medication-reminder and accountability service designed to help users organize medication schedules, receive reminders, record whether a dose was taken, and—where selected—notify an AcountAPill Partner when a dose is not confirmed or when the user requests help.
AcountAPill is intended to support medication-management routines. It is not a healthcare provider, pharmacy, prescribing service, diagnostic service, emergency service, or substitute for professional medical advice.
3. No Medical Advice or Emergency Service
Information and features provided by AcountAPill are for informational and organizational purposes only and are not medical advice. AcountAPill does not determine whether a medication is appropriate, safe, effective, necessary, or correctly dosed for you.
Users remain responsible for following the instructions of their physician, pharmacist or other qualified healthcare professional. Do not change, stop, double, or otherwise alter a medication because of information or a reminder supplied by AcountAPill.
AcountAPill is not an emergency notification system. If you believe you or another person is experiencing a medical emergency, contact 911 or the appropriate emergency service.
4. User Responsibilities
You are responsible for entering accurate medication names, doses, schedules, reminder preferences and contact information. You are also responsible for keeping your account credentials secure and for reviewing your medication information for accuracy.
You acknowledge that reminders, notifications, internet services, mobile devices, operating systems, email providers, cellular networks and third-party messaging services can experience delays, outages or failures. You should not rely on AcountAPill as the sole method of remembering or verifying a medication dose.
5. ACountAPill Partners
Where available, you may designate one or more trusted individuals as an “AcountAPill Partner.” You are responsible for obtaining any permission required to provide another person’s contact information and for ensuring that the information you provide is accurate.
Depending on your plan and settings, an AcountAPill Partner may receive notifications when a dose is not confirmed within the timeframe you selected or when you request help. Notifications and reports may contain information about medication activity. You should select only people you trust to receive this information.
6. Plans and Subscriptions
The Free Plan currently includes one medication reminder and one AcountAPill Partner. The Premium Plan is currently offered at $5.99 per month or $59.99 per year and includes up to 15 medications and up to 2 AcountAPill Partners, together with the other Premium features described on the website.
Features, limits and pricing may change. If material changes affect an active paid subscription, AcountAPill will provide notice where required by applicable law.
7. Billing, Renewal and Cancellation
Paid subscriptions may renew automatically according to the subscription option selected by the user. Applicable taxes may be added. Subscription management, cancellation, refunds and renewal terms may also be governed by the app store or payment provider through which the subscription was purchased.
Cancellation generally stops future renewal; unless applicable law or the applicable payment provider requires otherwise, fees already charged for a subscription period are not necessarily refundable.
8. Intellectual Property
The AcountAPill name, branding, logos, website content, software, designs, graphics and other materials are owned by or licensed to AcountAPill and are protected by applicable intellectual-property laws. You may use the
Services only for their intended personal or authorized business purpose and may not copy, modify, distribute, reverse engineer or exploit the Services except as permitted by law.
9. Third-Party Services
AcountAPill may rely on third-party services such as app stores, cloud hosting, analytics, email, SMS or push-notification providers and payment processors. ACountAPill is not responsible for outages, delays, errors or policies of independent third parties.
10. Availability and Changes to the Services
We may modify, suspend or discontinue all or part of the Services, including particular features, from time to time.
We do not guarantee that the Services will always be available, uninterrupted, secure or error-free.
11. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. AcountAPill disclaims warranties not expressly stated in these Terms, including implied warranties to the extent permitted by law.
To the maximum extent permitted by law, AcountAPill will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss arising from reliance on a reminder, notification, medication record, report, partner notification or interruption of the Services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
12. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless AcountAPill and its owners, employees, contractors and service providers from claims, losses, liabilities and expenses arising from your misuse of the Services, violation of these Terms, or provision of inaccurate or unauthorized information.
13. Termination
AcountAPill may suspend or terminate access where reasonably necessary, including for misuse, security concerns, unlawful activity, or material violation of these Terms. You may stop using the Services at any time.
14. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-law principles. Any dispute will be subject to the applicable courts of British Columbia, unless applicable law requires otherwise.
